An Overview:

The Facts:

YORK1, a waste management service company based out of Mississauga, Ontario purchased 29831 Irish School Road on December 15, 2022 through a private sale (87.8 acres). The location of a former tile yard and dormant fly ash landfill that sits between the Dresden town limits and Chatham-Kent border of Lambton County. The location of this property is less than 1km from Dresden town line and 700 meters from the local high school. 


Through a separate company, they have purchased 2 additional properties.

- Approximately 95.4 acre farm to the south of 29831 Irish School Road on October 20, 2023

- Approximately 47.9 acre farm to the north of 29831 Irish School Road on October 26, 2023

YORK1's website states they plan to introduce a "Regenerative Recycling Facility" for construction material waste including asbestos and silica dust. As of March 8, 2024 the company intends to reopen the previous fly ash landfill under the 2 pre-existing environmental compliance approvals (listed below).

Pre-Existing Environmental Compliance Approval for Waste Storage, Transfer and Processing - ECA A020

- Given under the Environmental Protection Act, 1990 on October 9, 1998.

- Site usage limited to storage, transfer, and processing of non-hazardous solid waste from industrial, commercial, institutional, and municipal sectors.

- Operations confined to 2 acres of the site, accepting a maximum of 75 tonnes per day, with a storage limit of 75 tonnes on-site.

- Hours of operation: 7:00 am - 9:00 pm Monday-Saturday

Existing Environmental Compliance Approval for Waste Disposal Site - ECA A021304

- Given under the Environmental Protection Act, 1971 on November 20, 1980.

- Authorization granted for the operation of an 8-hectare landfilling site within a total site area of 35 hectares.

- Allowed disposal:

  • 5% commercial waste
  • 95% "Other" waste, limited to incinerator ash.

YORK1 has made 2 Proposals to the MECP:

 Application 1:

ECA No. A020401 for Waste Storage, Transfer, and Processing Site:

- This application is confirmed by MECP

- Notice was given to the Municipality on January 29, 2024

 

Proposed Amendment to Environmental Compliance Approval for Waste Storage, Transfer, and Processing ECA No. A020401 (1998) 

  • Increasing the facility size from 0.8 ha to 25 ha.
  • Raise daily receiving rate from 75 tonnes to 6000 tonnes.
  • Include 3000 tonnes of construction waste, 3000 tonnes of soil, and 1000 tonnes for off-site disposal.
  • Indoor storage of 1800 tonnes and outdoor storage of 3000 tonnes of materials.
  • Outdoor storage of 30,000 tonnes of unprocessed soils.
  • Process additional waste types: blue box material, organics, asbestos-containing material, tires, soil, and soil-like material.
  • Permit 24/7 operations.
  • Install buildings and equipment for permitted uses.


Application 2:

ECA No. A021304 for Waste Disposal Site (Landfill)

- This application is confirmed by MECP

- Notice was given to the municipality by MECP on February 26, 2024


Proposed Amendment by YORK1 to Environmental Compliance Approval for Waste Disposal Site ECA No. A021304 (1980) 

  • Waste capacity: 1,620,000 m³.
  • Fill limit: 8 ha (20 acres).
  • Max fill rate: 365,000 tonnes/year (avg. 1000 tonnes/day).
  • Acceptable waste types: non-hazardous industrial, commercial, institutional, and municipal demolition/construction waste; non-hazardous contaminated soil.
  • Operating hours: 7:00am - 7:00pm, 7 days a week

Chatham-Kent Zoning By-Law:

The property at 29831 Irish School Road is currently zoned as "Extractive Industrial - 365" or "M2-365" 


The permitted uses include: 

- Agricultural Uses (no structures) 

- Asphalt and Concrete Batching 

- Buildings and Structures related to above permitted uses 

- Open Storage 

- Pits and Quarries 

- Processing of Extracted Materials from the site 

- Storage of Asphalt and Concrete for crushing (Special Zone Provision No.365) 


Planning act approvals by Chatham-Kent are required to change permitted uses in the Zoning By-Law
